1. Acceptance of Terms

By accessing or using PostPetal ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PostPetal is a social media management platform that allows you to:

• Create and schedule posts for multiple social media platforms
• Connect and manage social media accounts
• Use AI-powered tools to generate content
• Access templates for post creation
• Manage multiple brands from a single dashboard

3. Account Registration

To use the Service, you must:

• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription Plans

4.1 Plan Types

• Starter ($9.99/month): 1 brand, 4 social accounts, 240 posts/month, 40 AI credits/month
• Pro ($17.99/month): 2 brands, 10 accounts per brand, 600 posts/month, 80 AI credits/month
• Business ($39.99/month): 5 brands, 10 accounts per brand, 1,500 posts/month, 200 AI credits/month

4.2 Billing

Paid subscriptions are billed monthly in advance. Payment is processed through our payment provider, Polar.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

5. Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Post content that is illegal, harmful, threatening, or defamatory
• Infringe on intellectual property rights of others
• Spam, harass, or send unsolicited communications
• Attempt to gain unauthorized access to our systems
• Violate the terms of connected social media platforms

6. Content Ownership

6.1 Your Content

You retain ownership of all content you create and upload. By using the Service, you grant us a license to store, display, and transmit your content as necessary.

6.2 AI-Generated Content

Content generated by our AI is provided as suggestions. You are responsible for reviewing AI-generated content before publishing.

7. Social Media Platform Terms

When connecting social media accounts, you must comply with each platform's terms of service. We are not responsible for:

• Changes to platform APIs that affect functionality
• Account suspensions or bans by social platforms
• Content removal by social platforms

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance, modify features, or suspend service due to security concerns.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless PostPetal from any claims, damages, or expenses arising from your use of the Service, content you create, or your violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service immediately ceases. You may delete your account at any time through your account settings.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and PostPetal
• Severability: If any provision is found unenforceable, the rest remains in effect
• No Waiver: Failure to enforce a provision does not waive our right to enforce it later
